Nonsequitur: Obama’s “Recess” Appointments Declared Unconstitutional

Today the U.S. Court of Appeals for the D.C. Circuit unanimously declared President Obama’s “recess” appointments to the National Labor Relations Board to be unconstitutional.  Of course, this is because the President made these appoints while the Senate was IN SESSION.  This means that hundreds of decisions made by the board are invalid because the board lacked a legal quorum.  The administration will certainly appeal, but it’s hard to see how they win this one.
