The IRS may have broken the law by failing to report Lois Lerner’s missing e-mails to the court and plaintiff (Judicial Watch) of a current FOIA lawsuit. The agency will appear before a federal judge to explain why they did not update parties regarding the destroyed hard drive. More information here.

In a unanimous decision, the Supreme Court determined that President Obama’s “recess appointments” to the National Labor Relations Board were unconstitutional. Basically, the court decided that while the president does have the authority to make recess appointments, the Congress was not truly in recess when President Obama made the appointments. More than a thousand NLRB case decisions will most likely be invalidated by this decision.

The Middle East that Obama inherited in 2009 was largely at peace, for the surge in Iraq had beaten down the al Qaeda-linked groups. U.S. relations with traditional allies in the Gulf, Jordan, Israel and Egypt were very good. Iran was contained, its Revolutionary Guard forces at home. Today, terrorism has metastasized in Syria and Iraq, Jordan is at risk, the humanitarian toll is staggering, terrorist groups are growing fast and relations with U.S. allies are strained.
